Booking & Payment

​

A non-refundable retainer/deposit is required to secure all bookings. A session date is not officially reserved until the required payment has been received.

Remaining balances must be paid in full before the delivery of any final images, videos, galleries, or media files.

Late payments may result in delayed editing, delayed delivery, cancellation of services, or additional fees.

Cancellations & Rescheduling

​

Cancellations must be made at least 72 hours before the scheduled session.

Rescheduling is subject to availability. A rescheduling fee may apply, especially for short-notice changes, repeated reschedules, or changes requiring additional preparation.

If the client fails to arrive, arrives significantly late, or does not communicate, the session may be considered canceled and the retainer/deposit may be forfeited.

Weather-related or emergency rescheduling will be handled at BD3 Productions’ discretion with the goal of serving the client fairly.

Turnaround Time

​

Standard photo delivery is 10–14 business days after the photo selection date, unless otherwise agreed in writing.

Standard video delivery is 14–21 business days, depending on project scope, complexity, and revision needs.

Rush delivery may be available for an additional fee and must be approved before or at the time of booking.

Turnaround times may be affected by late payments, delayed client responses, project changes, high-volume seasons, or unforeseen circumstances.

Editing & Final Delivery

​

BD3 Productions selects and edits the final images and/or media delivered to the client. Editing style, color grading, retouching level, and final image selection are completed according to BD3 Productions’ creative judgment and brand standard.

Raw, unedited files are not included unless agreed to in writing.

Final galleries, downloads, or media files may be delivered through an online gallery, file transfer platform, email, or other approved delivery method.

Client Responsibilities

The client is responsible for providing accurate session details, including date, time, location, number of participants, session type, and any special requests.

The client is responsible for arriving on time and prepared for the session.

The client is responsible for securing permission, permits, access, or approvals for any requested location unless otherwise agreed.

BD3 Productions is not responsible for location restrictions, denied access, weather conditions, wardrobe issues, hair/makeup delays, or other factors outside of our control.

Intellectual Property & Usage Rights

​

BD3 Productions retains the copyright and ownership of all photos, videos, edits, and media created.

Clients receive a personal-use license to download, print, and share delivered media unless a commercial-use license is agreed to in writing.

Clients may not sell, alter, edit, filter, redistribute, or claim ownership of BD3 Productions’ work without written permission.

Commercial use, brand use, advertising use, or publication use may require a separate agreement or licensing fee.

Client Image Use & Portfolio Rights

​

BD3 Productions may use selected images or media for portfolio, website, social media, marketing, promotional, or business purposes unless otherwise agreed in writing.

Clients who require privacy or restricted media use must request this before the session or booking is finalized.

For minors, parent or guardian approval may be required for media use.

Revisions

​

Minor revisions may be considered at BD3 Productions’ discretion.

Revisions do not include changing the overall creative style, re-editing an entire gallery, removing natural features beyond standard retouching, or requests that fall outside the original agreement.

Additional revisions, advanced retouching, or special editing requests may require an additional fee.

Limitations of Liability

​

BD3 Productions is not liable for indirect damages, missed opportunities, emotional distress, loss of income, data loss, or issues resulting from the client’s use of delivered media.

If unforeseen circumstances prevent BD3 Productions from fulfilling services, BD3 Productions may reschedule, provide a replacement solution, or issue a refund at its discretion.

BD3 Productions’ total liability shall not exceed the amount paid by the client for the specific service in question.

Agreement

​

By booking, submitting payment, signing a contract, or participating in a session, the client confirms that they have read, understood, and agreed to these Terms & Conditions.
